TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using the BALLERS.AU platform ("Platform"), including submitting a player registration form, creating a club account, or logging into the club portal, you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a binding legal agreement between you and BALLERS.AU ("we", "us", "our"). We may update these Terms from time to time. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.

2. Platform Description

BALLERS.AU provides a software platform that enables basketball clubs and associations to:

  • Create and publish trial sessions and accept online player registrations.
  • Manage player data, team rosters, and communications.
  • Book and manage courts at BALLERS.AU managed venues and third-party facilities.
  • Access a Venue Manager Portal to manage court availability, blocks, and monthly booking exports.
  • Process court hire billing through Stripe metered billing.

BALLERS.AU is a technology platform only. We do not organise, run, supervise, or take responsibility for any basketball trial, session, program, or event listed on the Platform.

3. Parent / Guardian Obligations

By submitting a player registration, you confirm that:

  • You are the player's parent or legal guardian, or you are otherwise authorised to provide the player's personal information and to consent on their behalf.
  • All information you provide is accurate, complete, and not misleading.
  • You accept full responsibility for the accuracy of the information you submit, including the player's name, date of birth, gender, and contact details.
  • You understand that the information you submit will be shared with the relevant participating club and with service providers that help operate the Platform, in accordance with our Privacy Policy.
  • You accept that BALLERS.AU is not a party to any agreement between you and the participating club, and that any dispute about a trial outcome, team selection, or club decision is a matter between you and the club.

4. Club Obligations

Clubs that access the Platform agree that:

  • They will only use personal information accessed through the Platform for the purpose of administering their own trials and programs, and not for any other purpose.
  • They are independently responsible for complying with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and any other applicable laws in relation to personal information they access or use through the Platform.
  • They will implement reasonable security measures to protect personal information accessed through the Platform.
  • They will not share club portal login credentials with unauthorised persons.
  • They will promptly notify BALLERS.AU of any suspected data breach or unauthorised access to their account.
  • They are solely responsible for the conduct of their trials, the safety of participants, and all decisions about team selection, grading, and player outcomes.
  • They will not use the Platform to send unsolicited commercial messages or to engage in any unlawful conduct.

5. Accuracy of Information

BALLERS.AU does not verify the accuracy of information submitted by users or clubs. We are not responsible for errors, omissions, or inaccuracies in registration data, session details, club information, or any other content submitted to the Platform. Users and clubs are solely responsible for ensuring that the information they provide is accurate and up to date.

5a. Court Booking & Venue Use

Clubs that book courts through the Platform agree that:

  • Court bookings at BALLERS.AU managed venues are subject to the rates set by the venue and displayed in the Club Portal at the time of booking.
  • Bookings are confirmed immediately upon submission. Cancellations are subject to the venue's cancellation policy. BALLERS.AU is not responsible for any charges incurred due to late cancellations.
  • Clubs are responsible for ensuring their nominated users only book courts for legitimate club activities.
  • Venue blocks (e.g. for rep training or maintenance) set by venue managers take precedence over club bookings. BALLERS.AU is not liable for any loss arising from a venue blocking a previously available slot.
  • Monthly court hire invoices are generated automatically via Stripe based on hours booked during the billing period. Clubs are responsible for ensuring their Stripe payment method remains valid.

5b. Venue Manager Access

Venue managers who access the Venue Manager Portal agree that:

  • They will only use the Portal to manage courts and bookings at the venue for which they have been granted access.
  • They will keep their login credentials confidential and not share them with unauthorised persons.
  • They will promptly notify BALLERS.AU of any suspected unauthorised access to their account.
  • They are responsible for the accuracy of venue information, court details, and block bookings they create or modify.
  • Booking data exported from the Portal is for internal use only and must not be shared with third parties without the consent of the relevant clubs.

5c. Platform Subscription

Access to the Club Portal and associated platform features is provided on a subscription basis. Subscription fees are billed monthly or annually as agreed at the time of sign-up. Founding member pricing is locked for the term agreed at onboarding. BALLERS.AU reserves the right to update subscription pricing with 30 days' written notice. Continued use of the Platform after a price change takes effect constitutes acceptance of the new pricing.

6. Payments

All payments — including registration fees, court hire charges, and platform subscription fees — are processed by Stripe, Inc., a third-party payment processor. BALLERS.AU does not store full payment card details. All payment transactions are subject to Stripe's terms of service and privacy policy. Registration fees are set by individual clubs and are non-refundable unless the club expressly agrees otherwise or as required by law. Court hire charges are calculated based on actual usage and are non-refundable except where a booking was cancelled in accordance with the applicable venue cancellation policy. BALLERS.AU is not responsible for any payment disputes between you and a participating club or venue.

7. Limitation of Liability

To the maximum extent permitted by law, BALLERS.AU and its officers, employees, contractors, and agents:

  • exclude all liability for any loss or damage (including indirect, consequential, or economic loss) arising from your use of the Platform or reliance on any information on it;
  • are not responsible for the conduct, decisions, or actions of any participating club, including trial outcomes, team selections, or communications;
  • are not responsible for any injury, loss, or damage suffered by a player at or in connection with a trial or program listed on the Platform;
  • are not responsible for the accuracy, completeness, or currency of any information submitted by users or clubs;
  • are not liable for any failure or delay in the Platform caused by circumstances beyond our reasonable control, including internet outages, third-party service failures, or force majeure events.

Where liability cannot be excluded by law (including under the Australian Consumer Law), our liability is limited to the maximum extent permitted, including by limiting our liability to re-supplying the relevant service.

8. Indemnity

You agree to indemnify and hold harmless BALLERS.AU and its officers, employees, and contractors from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • your breach of these Terms;
  • inaccurate or misleading information you submit to the Platform;
  • your violation of any applicable law or the rights of any third party; or
  • (for clubs) your handling of personal information accessed through the Platform.

9. Intellectual Property

All content, software, trademarks, and materials on the Platform are owned by or licensed to BALLERS.AU. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent. Club logos and branding uploaded to the Platform remain the intellectual property of the respective clubs.

10. Account Termination

We may suspend or terminate a club's access to the Platform at any time if we reasonably believe the club has breached these Terms, engaged in unlawful conduct, or used the Platform in a way that harms other users or the Platform's integrity. Clubs may request account closure at any time by contacting us. Upon closure, we will handle any remaining personal information in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the non-exclusive jurisdiction of the courts of Australia.
